The Cape Town Refinery in Milnerton, operated by Astron Energy (Pty) Ltd (“Astron Energy”), operates under an Atmospheric Emission Licence (AEL) (Ref. No.: WCCT011) granted in terms of the National Environmental Management: Air Quality Act 39 of 2004 (NEM:AQA).
An AEL for the following listed activities was previously issued and was valid until 18 June 2024:
In January 2024 Astron Energy applied to renew the AEL in terms of Section 47 of the NEM:AQA.
Erf 936, Refinery on corner of Plattekloof and Koeberg Roads, Cape Town, Western Cape
On 14 June 2024, the City of Cape Town (CoCT) renewed the AEL for the Cape Town Refinery and in terms of NEM:AQA. The AEL renewal is subject to a number of conditions which, along with the reasons for the decision, are set out in the letter of decision (see below).
In terms of Section 40(4)(c) of the NEM:AQA, Section 62 of the Municipal Systems Act 32 of 2000, as amended and the appeal instructions from the CoCT, any person wishing to appeal the decision must submit an appeal to the City Manager within 21 days of the date that the notification of the decision (i.e. by 17 July 2024) was issued to the registered interested and affected parties.
